FAVORABLE RESULT IN THE CASE OF MIMO NE 67, LLC VS. CITY OF MIAMI
The Plaintiff, who became owner in December, 2018, filed for injunctive relief to stop demolition of two structures located at 515 NE 67 Street in Morningside. The rear structure had been set on fire and the front structure was abandoned and occupied by squatters who caused roof damage, removed electrical wiring, plumbing along with other damage. The Unsafe Structure Panel ordered the structures demolished within 30 days on March 1, 2019. The City bid out and was ready to proceed with demolition when the Plaintiff filed the injunction. The property is located down the block from Morningside K-8 School. The injunction was filed on August 15, 2019 with our office not receiving the pleading until August 20, 2019. The Plaintiff attempted to obtain an ex-parte injunction from the Court but, the Court denied the request and set the matter on an emergency basis for August 22, 2019 at 8:30 am. The City filed its Motion to Dismiss on August 20, 2019, the same day the pleading was received. At the hearing, the Court granted the City’s Motion to Dismiss.
