Miami Zoning Code Update

Adopted in 2009, the City of Miami 21 Zoning Code ("Code") establishes standards and procedures for new development or redevelopment in the City of Miami ("City"). It also incorporates the Miami 21 Atlas, which acts as the official Zoning Atlas of the City and designates a Transect Zone for all lands within the City. 

While the Code has been updated periodically, it has not been comprehensively updated in more than 10 years. On December 12, 2019, Miami’s City Commission directed the City Administration to conduct a comprehensive review of the Miami 21 Zoning Code (R-19-0523). To that end, the Mayor and City Commission appointed a 12-member task force to collaborate with the City to conduct that review and create a Miami 21 Task Force Report.

Recommendations may be incorporated into the discussion items for an upcoming meeting.

The following resolutions were set forth by the City Commission in order to conduct a comprehensive review of Miami 21 and recommend possible changes:

Study Areas

The scope of the Task Force study areas included the following topics.  Each meeting focused on one of the topics in the order set forth below. 

1. Affordability

  • Accessibility, availability, and incentives for applicants to provide affordable housing.
  • Discrepancy between City and County AMI impact on affordable units.
  • How AMI impacts supply and demand to effect market rate housing.
  • Gentrification and Displacement
  • Effects on Income inequality
  • ADU’s

  • Noticing and conducting quasi-judicial hearings
  • Navigability and usability of M21 code by stakeholders.

6. Assessment, (Internal)

  • Has M21 created more mixed-use and transitional zones on a city-wide basis.
  • Interaction with MCNP
  • M21 Atlas reflecting Gov. owned properties (They don’t play by our rules)
  • Number of approved developments since M21 has been in effect
